Effective Date: June 1, 20251. Acceptance of Terms
Welcome to The Maker Lab LLC ("The Maker Lab," "we," "our," or "us"). By accessing our website, purchasing products or services, attending workshops, submitting files for production, or otherwise engaging with our business, you agree to be bound by these Terms of Service.
If you do not agree with these Terms, please do not use our services.
2. Services
The Maker Lab provides, among other services:
3D printing and additive manufacturing
Laser cutting and engraving
CNC machining and fabrication
Vinyl graphics, decals, and signage
Design and prototyping services
Educational programs, workshops, and training
Custom manufacturing and production services
We reserve the right to modify, suspend, or discontinue any service at any time.
3. Customer-Provided Files and Content
Customers may submit digital files, artwork, logos, designs, text, photographs, CAD files, or other materials for production.
By submitting content, you represent and warrant that:
You own the content or have all necessary rights and permissions to use it.
The content does not infringe any copyright, trademark, patent, trade secret, or other intellectual property rights.
The content does not violate any applicable law.
The Maker Lab reserves the right to refuse any order that appears unlawful, offensive, unsafe, or infringing.
4. Intellectual Property Responsibility
Customers are solely responsible for ensuring they have legal authorization to reproduce submitted designs, logos, trademarks, copyrighted materials, and other protected content.
The Maker Lab assumes no responsibility for verifying ownership rights and may rely on customer representations regarding authorization.
Customers agree to indemnify and hold harmless The Maker Lab from any claims arising from submitted content.
5. Quotes, Pricing, and Payments
Quotes are valid for thirty (30) days unless otherwise stated.
Prices are subject to change without notice due to fluctuations in labor, materials, shipping, or supplier costs.
Payment may be required before production begins.
For approved commercial accounts, payment terms may be specified separately on invoices.
Late payments may incur applicable fees and collection costs permitted by law.
6. Deposits and Custom Orders
Custom projects may require a deposit before work begins.
Once production has started, deposits are generally non-refundable.
Custom-manufactured products, personalized items, and made-to-order products are generally not eligible for refunds unless defective due to our manufacturing error.
7. Proof Approval
Customers are responsible for reviewing all proofs, renderings, mockups, dimensions, spelling, colors, and layouts before approval.
Approval of a proof constitutes acceptance of all aspects of the design.
The Maker Lab is not responsible for errors contained in customer-approved proofs.
Additional charges may apply for revisions requested after approval.
8. Manufacturing Variations
Due to the nature of manufacturing processes, slight variations may occur in:
Color
Material appearance
Surface finish
Dimensions
Texture
Layer lines
Engraving depth
Material characteristics
Such variations are considered normal and do not constitute defects.
9. Turnaround Times
Estimated production and delivery dates are provided as a courtesy only.
Production schedules may be affected by equipment availability, material shortages, shipping delays, weather, customer response times, or other circumstances beyond our control.
The Maker Lab does not guarantee specific completion dates unless expressly agreed in writing.
10. Shipping and Delivery
Risk of loss transfers to the customer upon delivery to the carrier.
Customers are responsible for inspecting shipments upon receipt and reporting damage promptly.
Shipping delays caused by carriers are outside our control.
11. Educational Programs and Workshops
Participation in workshops, classes, and training programs may involve the use of tools, machinery, and equipment.
Participants agree to:
Follow all safety instructions.
Use equipment only as authorized.
Comply with staff directions.
Wear required safety equipment.
The Maker Lab reserves the right to remove participants who fail to follow safety requirements.
12. Assumption of Risk
Participation in fabrication activities, workshops, classes, and equipment use involves inherent risks.
By participating, individuals voluntarily assume all associated risks to the fullest extent permitted by law.
Where required, separate waivers or release forms may also apply.
13. Limitation of Liability
To the fullest extent permitted by law, The Maker Lab shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages.
In all cases, The Maker Lab's maximum liability shall not exceed the amount paid by the customer for the specific product or service giving rise to the claim.
14. Disclaimer of Warranties
Except as expressly stated in writing, products and services are provided "as is" and "as available."
The Maker Lab disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
15. Website Use
Users agree not to:
Violate any applicable law.
Attempt unauthorized access to systems or data.
Interfere with website functionality.
Upload malicious code or harmful content.
We reserve the right to restrict access for violations of these Terms.
